Agreement Acceptance
By registering and creating a profile on the website for Cycologie Studio de Spin Inc., ("Cycologie"), I understand that I am setting up an account that enables me to book and purchase sessions, packages, and memberships (collectively referred to as "Sessions"). I acknowledge that my purchase grants me access to the services ("Services") offered by Cycologie and is governed by these terms and conditions.
Purchases and Refunds
I understand that all purchases of Sessions are final and non-refundable, except where required by applicable laws.
Reservation and Cancellation
I agree to make reservations for Sessions either online or via telephone and to cancel them before 7 p.m. on the day prior to the scheduled Session. If I fail to cancel by this deadline, the Session will be considered attended, and I will not be allowed to reschedule. As an unlimited membership holder, I will incur a late cancellation fee of twenty dollars ($15) for cancellations past the 6 p.m. deadline, and a no-show fee of twenty-five dollars ($25) if I fail to attend a reserved session.
Membership Suspension
I am allowed to suspend my membership for a total period of one month. During this suspension, the monthly fee will still be collected, and the membership term will be extended by the corresponding period at the end of the contract.
Penalty for Contract Termination
I understand that a termination penalty of $285 plus applicable taxes will be charged if I terminate the membership contract before its expiry.
Rules and Regulations Compliance
I agree to diligently comply with the Rules and Regulations of Cycologie, which are available on the studio’s website and may be updated periodically. I understand that non-compliance may lead to disciplinary action, including the termination of services.
Non-Transferability of Account
I acknowledge that my account and all associated benefits are personal to me and not transferable. I agree not to share my account access or disclose account information to any third party. If a membership is found to be used by someone other than myself, it will be immediately suspended without notice.
Assumption of Risk
I understand that participating in the Services involves risks of personal injury and other damages. I agree that it is advisable to consult a licensed physician before participating. Despite precautions, I recognize that accidents and injuries may occur during my use of the studio's facilities and participation in the Services. By signing up for an account and participating in the Services, I assume all inherent risks associated with such activities.
Liability Waiver
Except in cases of gross negligence or willful misconduct by Cycologie, I hereby release and forever discharge Cycologie, its representatives, and its employees from any claims, damages, demands, rights of action, or causes of action, present or future, known or unknown, anticipated or unanticipated, resulting from or arising out of my attendance at or use of Cycologie or my participation in any of the Services.
Data Protection and Privacy
I understand that the Cycologie website uses cookies to monitor user preferences, and I can disable cookies in my web browser’s settings. The personal information I provide during the signup process will be used as detailed in our privacy policy, primarily for managing my account and providing Services, and will be handled in compliance with applicable data protection laws.
Personal Information Management
For purposes of these Terms and Conditions, "Personal Information" includes identifiable data such as my full name, date of birth, mailing address, email address, and telephone number, which are collected to uniquely identify me and manage services such as account setup, Session purchases, newsletter subscriptions, and promotional offerings. Access to my Personal Information is strictly limited to Cycologie’s Representatives, and is used to enhance customer service, manage transactions, and for internal marketing and demographic studies aimed at improving our offerings. My Personal Information may be disclosed to third parties for legal compliance, to protect the safety of any person, during business transactions like mergers or reorganizations, or to service providers who perform functions on our behalf under strict confidentiality agreements. Cycologie is committed to protecting the confidentiality and security of my Personal Information by employing appropriate safeguards, though I acknowledge that absolute security cannot be guaranteed. My Personal Information is retained only as long as necessary to fulfill the purposes it was collected for, including any legal, accounting, or reporting requirements, and any transmission of such data to our site is at my own risk.
Third-Party Links
I acknowledge that the Cycologie website may include links to other websites for convenience and further information. I understand that Cycologie does not endorse and is not responsible for the content of third-party sites.
Media Release
I agree to be photographed, recorded, and videotaped by Cycologie and its affiliates in connection with my participation in Cycologie activities. I irrevocably authorize Cycologie to copyright, publish, reproduce, exhibit, transmit, broadcast, televise, digitize, display, otherwise use, and permit others to use, my name, image, likeness, and voice, and all photographs, recordings, videotapes, audiovisual materials, writings, statements, and quotations of or by me (collectively, the "Materials"), in any manner, form, or format now or hereinafter created, including on the Internet, and for any purpose, including but not limited to, advertising or promotion of Cycologie, its affiliates, or their services, without further consent from or payment to me. I understand that all of the Materials are the sole property of Cycologie. I agree not to contest the rights or authority granted to Cycologie hereunder and hereby forever release and discharge Cycologie, its employees, licensees, agents, successors, and assigns from any claims, actions, damages, liabilities, costs, or demands whatsoever arising by reason of defamation, invasion of privacy, right of publicity, copyright infringement, or any other personal or property rights from or related to any use of the Materials. I understand that Cycologie is under no obligation to use the Materials.
Consumer Protection Clause (Quebec)
I am aware that I may cancel this contract without penalty or charge before Cycologie has begun the performance of its principal obligation by sending a written notice. If Cycologie has begun performing its principal obligation, I can cancel the contract within a time period equal to 1/10 the duration prescribed in the contract by sending a notice in writing. Cycologie may not charge more than one-tenth of the total contract price in such cases. The contract is canceled without further formality upon sending the notice, and any monies due must be refunded within ten days of cancellation. It is in my interest to refer to Sections 197 to 205 of the Consumer Protection Act (R.S.Q. C. P-40.1) and, where necessary, to communicate with the Office de la protection du consommateur for additional information or clarification on consumer rights under this act.
Acknowledgment of Terms and Conditions
By using the Services, I acknowledge having received a copy of these Terms and Conditions. I understand that Cycologie reserves the right to modify these terms periodically. I acknowledge that it is my responsibility to review the Terms and Conditions regularly to remain informed of any changes.
