1. Agreement Acceptance
By creating an account, purchasing any product or service, booking a class, or entering the premises of Cycologie Studio de Spin Inc. (“Cycologie”, “we”, “us”), you agree to be bound by these Terms of Service.
2. Purchases & Refunds
All sales (classes, packs, memberships, merchandise) are final and non-refundable except where required by the Consumer Protection Act (Québec).
3. Reservation, Late Cancellation & No-Show Policy
Cancellations must be made at least 12 hours before class start time.
Transform Monthly members and 1-week / 2-week unlimited intro offers: $20 late-cancel or no-show fee.
All other memberships and class packs: late cancel or no-show = loss of the class credit.
Repeated late cancellations or no-shows may result in temporary or permanent loss of booking privileges.
4. Membership Suspension
Memberships may be suspended for a maximum of one (1) month per calendar year. Monthly fees continue to be charged during suspension and the membership end date is extended by the suspended period.
5. Early Termination of Fixed-Term Membership
If you terminate a fixed-term membership before its expiry date, a termination penalty of $285 + applicable taxes will apply.
6. Waiver, Release of Liability & Assumption of Risk
I understand that indoor cycling classes are strenuous physical activities that carry risks of injury, serious injury, or (rarely) death, even when conducted properly.
I voluntarily assume all such risks, including those arising from equipment, lighting, music volume, other participants, or my own physical condition.
I agree to inform the instructor of any medical condition or injury before class and to stop immediately if I feel unwell.
To the fullest extent permitted by law, I release Cycologie Studio de Spin Inc., its instructors, employees, contractors, landlords and related parties (the “Cycologie Team”) from any liability for injury, loss or damage connected with my participation, even if caused by negligence (except gross or intentional fault).
I am responsible for my personal belongings (lockers are provided as a courtesy).
7. Conduct & Account Rules
Harassment, discrimination, bullying or any behaviour that makes others feel unsafe will result in immediate termination of access without refund.
Accounts are personal and non-transferable. Sharing or fraudulent use will result in immediate suspension or termination without refund.
Participants must be 16+. Minors under 18 require parental consent.
8. Photos & Video – Media Release
I authorize Cycologie to photograph, film or record me during classes and to use my name, image, likeness and voice for any legitimate purpose (marketing, social media, website, etc.) without compensation or further consent.
9. Privacy
My personal information will be used and protected in accordance with our Privacy Policy and applicable Québec and Canadian laws.
10. Governing Law & Jurisdiction
These terms are governed by the laws of Québec and federal laws of Canada applicable therein. Any dispute shall be submitted to the courts of the judicial district of Montréal.
11. Class Action & Jury Trial Waiver
To the extent permitted by law, claims must be brought individually (no class actions) and the right to trial by jury is waived.
12. Changes to Terms
Cycologie may modify these Terms at any time. Continued use of the services after changes constitutes acceptance of the new terms.
